Egypt : Mohamed ElBaradei - the Bill of Rights

Dear friends,

This is a Bill of Rights written and distributed by ElBaradei's campaign for suggested inclusion in the constitution.  A solid start, let us hope for a bright and progressive future for Egypt.  ElBaradei is likely to be a candidate for president in the presidential elections scheduled for December.

First, the Arabic version, then below it I translated it to English for those of you who unfortunately do not read Arabic!

وثيقة د البرادعي لحقوق الانسان

أعلن الدكتور محمد البرادعي, المرشح المحتمل لرئاسة الجمهورية, نص وثيقته لحقوق الإنسان بعد أن طرح مسودتها الأولية منذ أيام للنقاش داخل حملته، وعلى مستوى القوى السياسية والمرشحين لانتخابات الرئاسة، ومنظمات حقوق الإنسان، استعداداً لطرحها للاستفتاء لتكون جزءاً من الدستور الجديد لمصر.
وتضم الوثيقة بابين أساسيين الأول عبارة عن مبادئ أساسية تشمل 6 مواد، تتعلق بنظام الدولة، والثاني يضم 11 مادة عن الحقوق الأساسية للمواطن المصري، ومن المقرر إعلان الوثيقة في شكلها النهائي خلال مؤتمر صحفي تعقده الحملة في وقت لاحق الأحد.

وثيقة المبادئ والحقوق الأساسية

الباب الأول: مبادئ أساسية

مادة 1
نظام الدولة جمهوري ديمقراطي يقوم على حقوق المواطن وسيادة الشعب. ويمارس الشعب هذه السيادة من خلال نظام نيابي يقوم على انتخابات عامة نزيهة دورية تجري على أساس الاقتراع السري، وعلى قدم المساواة بين جميع المواطنين دون تمييز، ووفقاً لإجراءات تضمن حق الترشح والتصويت لجميع المصريين دون أي تفرقة.
مادة 2
الإسلام دين الدولة، واللغة العربية لغتها الرسمية، ومبادئ الشريعة الإسلامية المصدر الرئيسى للتشريع.
مادة 3
يقوم النظام السياسي على أساس تعدد الأحزاب السياسية، وللمواطنين حق إنشاء هذه الأحزاب ومباشرة العمل السياسي طالما لا تقوم هذه الأحزاب علي مرجعية أو أساس يتعارض وحقوق المواطنين الأساسية الواردة في هذه الوثيقة.
مادة 4
يقوم النظام العام على سيادة القانون واستقلال القضاء، وتخضع مؤسسات الدولة والمواطنون كافة للقانون على قدم المساواة ودون أي تفرقة.
مادة 5
القوات المسلحة هي درع الشعب وحامية السيادة الوطنية، وهي التي تتولى الدفاع عن استقلال وسلامة الوطن ضد الأخطار الخارجية، وتتولى القوات المسلحة وضع وتطوير ومراجعة النظم التي تكفل تحقيق هذا الهدف.
مادة 6
تلتزم الدولة ببذل أقصى جهد ممكن لتكفل لكل مواطن مستوى من المعيشة يوفر الصحة والرفاهية له ولأسرته، ويتضمن ذلك التغذية والمسكن والعناية الصحية والبيئة الآمنة وفرص العمل بشروط عادلة دون تمييز، وحمايته من البطالة، وتأمين معيشته في حالات البطالة والمرض والعجز والشيخوخة, وغير ذلك من فقدان وسائل العيش نتيجة لظروف خارجة عن إرادته. كما تلتزم الدولة بأن يكون التعليم مجانياً في مؤسساتها التعليمية بجميع مراحلها، وأن يكون القبول بهذه المؤسسات على أساس الكفاءة وعلى قدم المساواة التامة للجميع، وأن يكون التعليم الأولي والأساسي إلزامياً.

الباب الثاني: الحقوق الأساسية

مادة 1
الكرامة الإنسانية حق لكل فرد.
مادة 2
جميع المصريين أحرار متساوون في الحقوق والواجبات والحريات أمام القانون والدستور دون تمييز.
مادة 3
لكل مصري الحق في حرية الرأي والتعبير وفي التجمع السلمي، على أن تمارس هذه الحقوق دون الإخلال بحقوق الغير.
مادة 4
حرية العقيدة مكفولة، ولكل مواطن الحق في اعتناق العقائد والمذاهب وحرية ممارسة الشعائر الدينية، على أن تمارس هذه الحقوق دون الإخلال بحقوق الغير.
مادة 5
لكل مصري الحق في حرية الإقامة والتنقل، ولا يجوز القبض على أي مواطن أو احتجازه دون سند من القانون أو تعسفاً. وكل متهم بجريمة يعتبر بريئاً إلى أن تثبت إدانته قانوناً بمحاكمة عادلة علنية أمام قاضيه الطبيعي تؤمن له فيها جميع الضمانات الضرورية للدفاع عن نفسه، ولا يجوز بأي حال تعريض أي شخص للتعذيب أو المعاملة الحاطة بالكرامة.
مادة 6
لكل مصري حق التملك بمفرده أو بالاشتراك مع غيره، ولا يجوز تجريد أحد من ملكه دون سند من القانون أو تعسفاً.
مادة 7
الحق في العمل مكفول، ولكل مواطن الحق في إنشاء والانضمام إلى نقابات حماية لمصالحه وحقوقه.
مادة 8
لكل مواطن الحق في التعلم وتنمية المعارف والبحث العلمي والبحث عن المعلومات وتلقيها ونشرها، والمشاركة في الحياة الثقافية بتنوعاتها المختلفة، ويتضمن ذلك الحق في حرية الاختيار وحرية التعبير في الحياة العامة أو الخاصة, وحرية ممارسة الأنشطة الثقافية وإنتاج الخدمات الثقافية ونشرها وحرية الاستفادة من وسائل الإعلام والاتصال المختلفة.
مادة 9
لكل مصري الحق في التمتع بحرمة حياته الخاصة، بما يشمل حياة أسرته ومسكنه ومراسلاته وشرفه وسمعته، وأن يخضع لقانون الأحوال الشخصية الذي يتفق ومعتقداته دون الإضرار بحقوق الآخرين، ولكل شخص الحق في حماية القانون لهذه الحرمات.
مادة 10
ليس في هذه الوثيقة أي نص يجوز تأويله على نحو يفيد انطواءه على تخويل أي من مؤسسات الدولة أو الجماعات أو الأفراد أي حق في القيام بأي نشاط أو بأي فعل يهدف إلى إهدار أي من الحقوق والحريات المنصوص عليها في هذه الوثيقة.
مادة 11
هذه الوثيقة جزء لا يتجزأ من الدستور، والحقوق الواردة فيها غير قابلة للإلغاء أو التنازل أو التعديل أو التقييد، ويحق لكل مصري التمتع بها دون أي تمييزأو تفرقة، ويشكل  انتهاك أي من هذه الحقوق أو التحريض على انتهاك أي من هذه الحقوق جريمة ضد الدستور، سواء تم هذا الانتهاك بخرق القانون أوالدستور أو بتغيير أو محاولة تغيير أي منهما، ويحق لكل مصري دون تمييز اللجوء إلى القضاء لوقف مثل هذا الانتهاك أو التحريض على مثل هذا الانتهاك ومعاقبة مرتكبيه.

Dr. ElBaradei's document of human rights

Dr. Mohamed ElBaradei, a likely candidate for the presidency, announced his text of Human Rights after debating its earlier draft days ago within his campaign, with various political forces and other candidates for the presidency, as well as human rights organizations.  This is in preparation to submit it to a referendum for its inclusion in the new constitution for Egypt.

The document includes two main sections, the first lists basic fundamental principles that include six articles related to the state system, and the second includes eleven articles on the fundamental rights of the Egyptian citizen.  The document is scheduled to be announced in its final form during a press conference to be held by ElBaradei's campaign on Sunday.

Principles and Fundamental Rights

Part I: Basic Principles

Article 1

The state system is a democratic republic based on citizen rights and the sovereignty of the people.  The people shall exercise this sovereignty through a parliamentary system based on periodic and genuine elections conducted with a secret ballot, with equality among all citizens with no discrimination, and according to procedures that guarantee the right to run and vote for all Egyptians without any distinction.

Article 2

Islam is the state religion, and Arabic its official language, and the principles of Islamic Sharia the main source of legislation.

Article 3

The political system is based on the multiplicity of political parties, and the right of citizens to establish these parties and participate in political action as long as these parties are not based on principles contrary to the fundamental rights of citizens contained in this document.

Article 4

Public order is based on the rule of law and the independence of the judiciary.  State institutions and all citizens are subject to the law, equally and without discrimination.

Article 5

The armed forces are the shield of the people and the protector of national sovereignty.  They undertake the defense of the nation's independence and safety against external threats.  The armed forces undertakes the development, update and review of the systems that ensure the achievement of this goal.

Article 6

The State is committed to making the maximum effort possible to ensure that every citizen has a standard of living that provides him the health and well being for himself and his family.  This includes food, housing, health care, a safe environment, employment opportunities on fair terms without discrimination, protection from unemployment, security in the event of unemployment, sickness, disability and old age, and other loss of means of livelihood due to circumstances beyond his control.  The state is also committed that education, in all of its stages, is free in its educational institutions, and that admission to these institutions is on the basis of qualification and full equality for all.  Primary and basic education is compulsory.

Part II: Fundamental Rights

Article 1

Human dignity is the right of every individual.

Article 2

All Egyptians are free, have equal rights, duties and liberties before the law and the Constitution, without discrimination.

Article 3

Every Egyptian has the right to freedom of opinion and expression, to peaceful assembly, and to exercise these rights without prejudice to the rights of others.

Article 4

Freedom of religion is guaranteed, and each citizen has the right to hold beliefs and doctrines and the freedom to practice religious rites, and to exercise these rights without prejudice to the rights of others.

Article 5

Every Egyptian has the right to freedom of residence and movement.  No citizen may be arrested or detained arbitrarily or without the support of the law.  Every person accused of a crime is presumed innocent until proven guilty according to the law in a fair and public trial before the appropriate judge, during which the person is assured all the guarantees necessary for his defense, and no person will be subjected to torture or a treatment degrading to his dignity.

Article 6

Every Egyptian has the right to own property alone or jointly with others, no one shall be deprived of his property arbitrarily or without the support of the law.

Article 7

The right to work is guaranteed, and every citizen has the right to establish and join trade unions for the protection of his interests and rights.

Article 8

Every citizen has the right to education and the development of knowledge and scientific research, and to search for, receive and disseminate information, and to participate in the cultural life in its different forms.  This includes the right to freedom of choice and freedom of expression in public or private life, freedom of cultural activities and the production of cultural services and their dissemination, and the freedom to take advantage of various media and communication networks .

Article 9

Every Egyptian has the right to the inviolability of private life, including his family life, his home and his correspondence, honor and reputation, and is subject to the personal affairs law that is consistent with his beliefs without prejudice to the rights of others, and each person has the right to legal protection of these privacy laws.

Article 10

This document does not contain any text that may be interpreted as implying for any state institutions, groups or individuals, any right to engage in any activity or any act aimed at the destruction of any of the rights and freedoms set forth in this document.

Article 11

This document is an integral part of the Constitution and the rights contained therein are not subject to cancellation or waiver, modification or restriction, and every Egyptian has the right to enjoy them without any preference or discrimination.  A violation of any of these rights or abetting the violation of any of these rights is a crime against the Constitution, whether this violation was by breaking the law or breaching the Constitution or change or attempt to change any of them, and every Egyptian is entitled without discrimination to go to court for the stoppage of such violation or incitement to such violation and the punishment of the perpetrators.
